Call for Nominations – Notice Requirements Under Florida Statute Chapter 720
Under Chapter 720, Florida Statutes, a call for nominations for an HOA board election must be provided to parcel owners by an authorized form of notice, and posting alone is not sufficient.¹
Florida Statute §720.306 requires owners receive 'actual notice' of election-related matters, defined as notice delivered by mail, personal delivery, or electronic transmission with prior written consent of the owner.²
DBPR arbitration decisions consistently treat failures to provide statutory notice as election defects subject to mandatory arbitration and potential invalidation of the election.³
Accordingly:
• Mailing the call for nominations to all owners satisfies the statute.⁴
• Electronic notice is valid only for owners who have affirmatively consented in writing.²
• Posting on social media, kiosks, or association websites does not satisfy statutory notice requirements and may only supplement proper notice.⁵
Failure to comply with statutory notice requirements may subject the association to DBPR arbitration and enforcement under §§720.306, 720.311, and Rule 61B-80, Florida Administrative Code.⁶

Statutory and Arbitration Authorities
1. §720.306, Fla. Stat.
2. §720.306(2), Fla. Stat.
3. Wallace A. Ritchie v. Spruce Creek Property Owners’ Ass’n, Inc., DBPR Arb. Case No. 2005-01-6667 (Summary Final Order) (holding election disputes based on improper notice are arbitrable).
4. §720.306(2)(a), Fla. Stat.
5. Division of Condominiums, Timeshares, & Mobile Homes, Arbitration Guidance (recognizing failure to give adequate notice as an arbitrable election dispute).
6. §§720.306(9), 720.311, Fla. Stat.; Fla. Admin. Code R. 61B-80.101, 61B-80.103 (mandatory election arbitration procedures).
